A man in Switzerland has been convicted of rape after taking off a condom during the intercourse without the knowledge of the person with whom he was in bed with, reports Independent.

Criminal Court in Lausanne, Switzerland, ruled that having sex without a condom can be termed as rape if the use of one was expected by the partner.

The 47-year-old was given a 12-month suspended sentence on Monday, reports news agencies.

The French man met a Swiss woman of the online dating app Tinder. Ever since their second date back in 2015, the couple took to bed to express their emotional feelings for each other.

The court judged that the woman would have refused to have sex if she had known the condom would be removed as she realised it was removed only after the act was over.

The victim’s lawyer has described the conviction as “a first for Switzerland”.
