At a time when chief justices and judges of high courts complain of not being transferred despite the recommendations of the collegium, there arises an incident when an additional district and sessions judge, RK Shriwas tired of being transferred four times in fifteen months has decided to sit for a ‘dharna’ voicing to reform the judiciary, outside the Madhya Pradesh High Court since yesterday.
I will sit till evening today and will again sit here tomorrow, continuing the dharna in coming days. I know High Court may take action against me and I could lose my job but I am no longer scared as someone had to do itRK Shriwas to reporters
"Where shall we go? Others can go to government but we have nowhere else to go except the High Court. I have decided to take this step as my conscience told me to do it. As per norms, there should be transfer once in three years but the rules are not followed. I have been transferred every few months — four times in 15 months, my kids are studying in different cities," he added. He was shifted from Dhar to Shahdol, then within months to Sihora and then to Jabalpur.
The judge also added that despite writing to the Chief Justice and the Registrar General of MP HC, no action was taken for his complaint. After being posted as an officer on special duty with the MP High Court he was again transferred to Neemuch.
The truth on the ground is different. When Supreme Court has laid down norms, they should be followed. I know there is now a risk to my job but I made up my mind to come in the forefront. I may be arrested or sent to jail too and I am ready for thatRK Shriwas
